During a separation or a divorce, it is necessary to make a decision concerning parental authority and child custody

L’autorité parentale est l’ensemble des droits et des devoirs des parents exercés dans l’intérêt de l’enfant.

Parental authority refers to the rights and duties of the parents, exercised in the best interest of the child.

In general, parental authority is exercised jointly by both parents. Exceptionally, it can be granted to only one parent when the other has committed serious misconducts (violence against children, sexual abuse, etc.)

However, when concerns arise regarding the safety, education, or care of the children, one parent may petition the Family Court Judge to request exclusive custody.

Article 373-2-1 of the French Civil Code states: “If the best interests of the child require so, the judge may entrust the exercise of parental authority to one of the two parents. Visitation and housing rights can only be denied to the other parent for serious reasons (…).”

To do so, the parent will need to provide evidence that their ex-spouse is unable to fulfill their role as a parent and that their behavior endangers the physical and mental health of the child

Our intervention

The investigatiosn will reveal the public behavior of the parent that jeopardizes the health and education of the children (frequent lateness to school, forgetting to pick up the child after class, stops at bars, etc.)

We’ll verify the child’s living conditions by taking into account the parent’s presence, their behavior (mistreatment, alcohol, drugs, neglect of the child, etc.), the use of daycare services, and the child’s leisure activities…

Our interventions will allow us to collect evidence in the context of visitation or housing rights

Service agreement

For each mission, a contract is drafted, specifying the purpose of the mission, the methodology, the financial terms, and the timeline for execution.

Lead investigator

Your case will be handled by a dedicated lead investigator who’s going to be your only contact, in charge of coordinating and managing the investigations.

Investigation report

At the conclusion of the investigations, a detailed, thorough, and precise investigation report will be drafted. It may be presented, if necessary, before the competent jurisdiction.

Practical

As part of the existing divorce proceedings, Mrs. X has been granted the marital home and custody of their two children, who are 2 and a half and one years old.

However, it was brought to the father’s attention that his wife had entrusted the care of one or both children to a man she employed as a private driver

In this context, Cabinet Arnoult International was commissioned to carry out investigations through surveillance and tailing operations.

During the surveillance period, we never observed our client’s wife being present with her two children. Instead, custody of the children was mostly entrusted to her private driver, who was found to have committed serious acts of negligence (leaving a child in the vehicle while he had drinks at a café; reckless driving, etc.).

Our detailed report allowed our client to obtain custody rights, supported by the emergency petition filed by his lawyer.
