Under the terms of Article 215 of the French Civil Code, spouses are mutually obligated to maintain a community of life: this duty, arising from marriage, must therefore be respected in the choice of a marital residence.

Ending this community of life constitutes a fault that the other spouse may invoke during divorce proceedings. In principle, spouses are not free to decide alone to end their community of life. Such a decision must be authorized by the judge. During the conciliation hearing, spouses are allowed to live separately.

Thus, the abandoned spouse must be able to prove the abandonment, which is why hiring a private investigation firm may become necessary.

Our intervention

Mr. X contacts us to determine the residence of his wife, who has left the marital home. Indeed, she informed him a few days earlier of her intention to file for divorce.
